Pensions Update

A joint statement was agreed by NDA, Trade Unions, and BNFL to inform employees of the latest position on pensions.
The following statement was acceptable to, and agreed by all parties:
"All employees within the BNFL Group, of companies employed on 1st April 2005 are covered by the Energy Act or the Cabinet Office "Fair Deal" and will enjoy the same protection as if the Energy Act applied to all. Additionally, all employees joining after 1st April 2005, and up to the date of any transfer, will be treated no differently. These protections will apply in the event of any involuntary transfer due to competition, company sale, "make v buy" or other restructuring programme and will continue to apply through all subsequent transfers."
BNFL agreed that this statement (giving Energy Act protection) will be included within the employment contracts of their existing employees.
It was noted that this would not replace any of the rights enjoyed by Electricity Supply Pension Scheme (ESPS) "protected persons" under the Electricity Act.
It is clear that Site Licence Company (SLC) employees (the large majority of the workforce) will either remain in their current pension scheme or transfer to the Combined Nuclear Pension Plan (CNPP) in the event of competition or company sale.
